TERMS OF SERVICE

Description:
By commissioning me, you agree that you have read and understand my Terms of Service.
The client must read, understand, and agree to all terms. By continuing with the commission and completing payment, the client has agreed to said terms.I. GENERAL TERMS
- I reserve the right to decline a commission without reason or explanation.
- Please communicate in English with clear and understandable grammar.
- When providing references, please include all details relevant to your commission so they will not be missed or left out.
- Inappropriate/aggressive behaviour of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, I reserve the right to cancel the commission.
- I cannot and will not be responsible for a client's budgeting. Please be sure that you have the means to purchase before asking for a commission- otherwise, I ask that you do not request my services until you are able to do so.
II. PAYMENT
- All commissions must be paid in full up front.
- I accept payment in USD only.
- Payment plans are only available to regular customers with prior discussion/approval.
III. PROCESS
- A Work in Progress (WIP) will be given upon request, or at my discretion to make sure everything in your commission is correct before completion.
- After a commission is complete, only small changes are allowed to be made. These changes include small colouring/marking mistakes or forgotten details. Major edits/changes requested after completion will result in additional fees.
- Please allow between 3-6 month turnaround for commissions. Larger/more complex commissions will result in a longer wait time.
Delays may occur due to one or more factors, including but not limited to:
- Health
- Order of commission
- Complexity of commission
- Mental health, or family issues
If any of the above issues occur, you will be notified immediately.
IV. COPYRIGHT / USAGE POLICY
I retain full commercial and distribution rights to any commissions I produce. I do not claim ownership or the rights to intellectual property or the character(s) depicted in commissions, unless they are my own. If you wish to use the work you commissioned, for commercial purposes, we will further discuss a fee in private.
As the artist, I am permitted to do the following:
- Post the art on any website/social media of my choosing
- Crop, edit, or alter the image for promotional use
- Make prints, digital portfolios, CDs, books etc. of the artwork
The commissioner is allowed to:
- Use the copyrighted artwork for personal use only, unless agreed otherwise
- Print the art, and claim the right of their character(s), but not the drawing itself
- Use the art to promote themselves with proper credit given to the artist
- Post the artwork in their personal galleries, with full credit given to the artist
If a client's commission has been stolen, misused, or falsely claimed by another individual, the client may report a removal request OR reach out to me to request removal.
Should Copyright Infringement occur, the client’s rights to the art will be forfeit.The following is considered Copyright infringement:- Reproducing, redistributing, or using the copyrighted artwork commercially
- Reselling/making money off the art without the artist’s prior consent
- Claiming credit for the creation of the artwork
- Removing any watermarks/signatures
- Altering the artwork without my, the artist's, consent
V. CANCELLING/REFUNDING POLICY
I reserve the right to cancel a commission and refund accordingly at any time.
Refunds will be handled on a case by case basis.- Refunds will NOT be given after a commission is completed.
- Commissions priced at $100 or more may take time to refund back to you in full.
- False chargebacks/claims will result in the client being blacklisted from all future purchases.

Any statement can be bound to change if discussed with me, the artist, prior to the commission.
